In this Partner Agreement (General Terms and Conditions), “we,” “us,” “our,” and “getanyboat” refer to the website getanyboat.com and its related online services, operated by Charlie Primas, Wernerstr. 44, 01159 Dresden. “You,” “your,” “user,” “advertiser,” and “partner” refer to the individual or entity using our website, including participation in the partner network. By accessing or using any service on this website, you expressly accept these Terms in their then-current version, which is available online at all times. Any terms and conditions proposed by you are excluded and will not apply under any circumstances, even if we do not expressly object to them. These Terms govern all existing and future business relationships between you and us.
Changes to these Terms and Conditions will be announced via a notice on getanyboat.com. If the advertiser does not agree, they may withdraw from the contract within 30 days of the effective date. Failure to withdraw within that period constitutes acceptance of the amended Terms and Conditions.
Any deviations from these Terms and Conditions, as well as any supplementary agreements or assurances beyond their scope, must be made in writing to be effective.
The contract between the advertiser and getanyboat is formed when we receive the required data submitted via the online forms on getanyboat.com (or related sites). Publication generally occurs only after payment is received. For other users, a contract is formed upon use of the services designated as paid.
The minimum term of all contracts for an advertisement can be found in the price lists of the respective websites. Deviating terms must be expressly agreed upon separately.
An advertiser is any individual or entity that, for a fee, uses the getanyboat website to offer others the opportunity to enter into a contract. A user is any other visitor to the website, whether they use free or paid services.
getanyboat allows advertisers to post listings on the website for the purpose of granting or transferring rights to boats or offering their use. Advertisers can create and edit individual listing pages within the password-protected “Partner Network” area. Anyone with access credentials must keep them secure and must not disclose them to third parties.
The user expressly guarantees that the provision and publication of the content of the information they have posted does not violate German law or the law of their home country, which may differ from this law, in particular copyright, data protection, and competition law. getanyboat is entitled to pass on to the user all costs arising from publications for a user on the Internet that violate applicable law if this violation is due to incorrect information provided by the user.getanyboat assumes no liability for the timeliness, accuracy, completeness, or quality of the information provided by the user.
The getanyboat website may not be used for any other purposes, particularly for general advertising or similar activities. Users agree not to publish, offer, or cause to be offered any pornographic or erotic content or services. In the event of a breach, getanyboat may terminate an advertiser's contract without notice or block the user's access to and use of the website. Each violation incurs a contractual penalty of EUR 2500.
getanyboat may refuse to publish or remove content for legal reasons and will notify the user of any deletion. In such cases, getanyboat may retain fees accrued up to the removal date and charge no more than an additional three months of publication fees; any prepaid excess will be refunded. The same applies if a third party requests changes or removal due to alleged rights infringements. If the user proves that no third-party rights are at risk, getanyboat will restore access to the pages. getanyboat may also conduct periodic spot checks of user content for potential third‑party rights issues and, if violations are found, issue warnings and/or withhold the content from publication.
Each advertisement may only be placed once. Only the photo of the respective boat or boat type may be used.
getanyboat reserves the right to place advertising banners for its own benefit on all of its websites.
The scope of services is determined by the content presented on the getanyboat websites.
getanyboat reserves the right to expand, modify, or reduce its offerings and to change the design of its websites. Furthermore, getanyboat reserves the right to make technical changes to the scope of services. Functionality will not be affected as far as possible.
Advertising fees are set by the applicable price lists on the respective websites. A paid service is deemed performed if an advertisement runs for at least 90% of the agreed term. If an advertisement runs for less than the agreed term due to the advertiser's fault, getanyboat may charge the full amount per the price list. If getanyboat is responsible for the shortened term and the runtime is under 90% of the agreed period, getanyboat may charge only a pro rata fee corresponding to the actual runtime.
To the extent that getanyboat provides free services, these may be discontinued at any time. This does not give rise to any claim for reduction, reimbursement, or damages.
Various services on the getanyboat websites are offered free of charge, but this may change. getanyboat reserves the right to introduce fees for certain services at any time and will notify users accordingly. Fees become payable once the user confirms their intention to use the relevant service on a paid basis. getanyboat may restrict or deny access to fee-based services if the user fails to pay the applicable fees after notice.
getanyboat is entitled to charge advertisers a fee according to the fee schedule for other services related to the creation and publication of advertisements.
getanyboat reserves the rights of use for published offers/content or content created by it. Reproduction or use of such graphics, audio documents, video sequences, and texts in other electronic or printed publications is not permitted without the express consent of getanyboat. In particular, the presentation pages are considered intellectual property. They may not be published individually or in their entirety on other websites or in other media. Further processing and use in any media is only permitted with the prior written consent of getanyboat. The advertiser's own rights to their advertisement(s) remain unaffected.
Since getanyboat is unable to review all changes made by the advertiser, responsibility for pages designed or co-designed by the advertiser rests solely with the person using the corresponding password.
Advertisers on getanyboat's websites are expressly prohibited from using graphics, audio recordings, video sequences, and texts in the design of their presentation pages that are subject to copyrights, trademarks, or property/ownership rights of third parties, unless they have the express permission of the respective owner.
getanyboat assumes no obligation to review advertisers' websites. getanyboat reserves the right to make changes and corrections if these are suitable for improving the appearance of the advertisement and do not impair the advertiser's identifiable interests. If the advertisement violates legal prohibitions, common decency, or these Terms and Conditions, the advertiser is liable for all resulting direct or indirect damages, including financial losses.
If getanyboat is held liable for violations of copyright or other third-party rights by online content posted by users, it is entitled to seek recourse against the responsible user.

For direct or indirect references to external websites (links) outside getanyboat's area of responsibility, getanyboat is liable only if it knew of unlawful content and, in the case of such content, it was technically feasible and reasonably expected to prevent access. getanyboat generally has no influence over the current or future design or content of linked pages and expressly disclaims responsibility for them. This applies to all links and references on its own website, as well as to third‑party entries in guest books, discussion forums, mailing lists, presentation pages, or other open areas provided by getanyboat. The services offered on the getanyboat websites and their corresponding contract terms are governed by the then-current price lists available online. If the advertiser defaults on any payment, getanyboat may withhold or suspend further services and charge interest on the overdue amount at 10% per annum.
If the user does not participate in the direct debit process, the invoiced amount must be credited to the bank account specified on the invoice by the due date stated there.
Price changes will be announced on the getanyboat websites in advance. They apply only to services used after the effective date and to contract renewals, including automatic renewals where the contract was not terminated in time.
All contracts may be terminated by giving one month's notice prior to the end of the term. If notice is not given in time, the contract renews for the period specified in the applicable price list on the relevant getanyboat website. The right to terminate without notice for good cause remains unaffected. Good cause includes, in particular, serious or repeated breaches of the contract—especially violations of these Terms—as well as situations where the contract cannot be performed. Upon termination for good cause, getanyboat may immediately deny access to the advertiser area and delete the pages associated with the contractual relationship, and may block and delete stored content without granting a grace period.
With its websites, getanyboat merely provides users with a platform for the transmission of information/content. Therefore, getanyboat assumes no liability for the information/content that users disseminate using this internet portal. The respective user is solely responsible for the accuracy of such information/content.
Information/content published by getanyboat on its websites is researched with the greatest possible care. Nevertheless, getanyboat assumes no liability for the accuracy, completeness, or timeliness of the information provided. The contributions, especially in the guestbook and forum, reflect the opinion of the respective author. Therefore, no guarantee is given for the accuracy and completeness of all or any individual information.
getanyboat does not verify the advertisements or the identity of the advertiser.
getanyboat is not liable for the loss of data unless the destruction of the data can be attributed to gross negligence or intent. Furthermore, the advertiser is obligated to retransmit the relevant data to getanyboat free of charge. The user has no claim to damages arising from the faulty functioning of the getanyboat websites that exceed the reimbursement of the corresponding fee.
getanyboat is not liable for damages resulting from the failure to provide the agreed services due to force majeure.
getanyboat is not liable for damages resulting from software transmitted via its websites.
The following applies to all of the above provisions: getanyboat is not liable for lost profits, lost savings, or indirect and/or consequential damages. These limitations of liability do not apply to damages resulting from intent or gross negligence, nor to damages to life, limb, or health of persons.
Unless expressly agreed otherwise, the information provided by getanyboat is not considered confidential. Data about the offer and contact options provided by the advertiser may be made accessible to third parties (e.g., entries in online directories, search engines, and similar services).
The user agrees that his or her data will be stored and used electronically in compliance with the data protection regulations applicable in Germany.
To the extent getanyboat uses third parties to provide the services offered, getanyboat is entitled to disclose user data if this is necessary to ensure operations.
The user, for his or her part, is not authorized to obtain data and information not intended for him or for third parties using the services provided by getanyboat.

The place of performance is Dresden, Germany. If the user is a merchant, Dresden is agreed as the place of jurisdiction. Furthermore, getanyboat is entitled to sue users at their general places of jurisdiction.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. Instead, the invalid provision shall be replaced by a provision that corresponds to or at least comes close to the purpose of the agreement, which the parties would have agreed to in order to achieve the same economic result if they had known of the invalidity of the provisions.
The same applies to the incompleteness of the provisions.
